1. ABOUT THESE TERMS
Welcome to House of Ellory.
These Terms of Use (“Terms”) govern your access to and use of the House of Ellory website, online store, and related digital services, content, features, and functionality (collectively, the “Site”).
Throughout these Terms, “House of Ellory,” “we,” “us,” and “our” refer to the entity operating House of Ellory. “You” and “your” refer to any person accessing or using the Site.
By accessing or using the Site, creating an account, placing an order, or otherwise using our Services, you acknowledge that you have read and agree to these Terms, together with any policies incorporated into them by reference.
If you do not agree to these Terms, please do not use the Site.
Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded or limited under applicable law.
2. ELIGIBILITY & USE OF THE SITE
You may use the Site only for lawful purposes and in accordance with these Terms.
By placing an order through the Site, you represent that you have the legal capacity to enter into the transaction or are otherwise authorized to do so under applicable law.
You agree not to use the Site:
- for unlawful, fraudulent, or abusive purposes;
- to interfere with the operation or security of the Site;
- to introduce viruses, malicious code, or other harmful technologies;
- to gain unauthorized access to systems, accounts, data, or networks;
- to collect or use information about other users without authorization;
- to impersonate another person or entity;
- to misrepresent your identity or affiliation;
- to infringe intellectual property, privacy, publicity, or other rights;
- to scrape, crawl, harvest, extract, reproduce, or systematically collect Site content or data except as expressly permitted by us or applicable law; or
- to use the Site or its content for a purpose competitive with House of Ellory where prohibited by applicable law.
We reserve the right to restrict or terminate access to the Site where we reasonably believe these Terms have been violated or where necessary to protect House of Ellory, our customers, or others.
3. ACCOUNTS
Certain Site features may permit or require creation of an account.
You agree to provide information that is accurate and current and to update that information when necessary.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account to the extent permitted by applicable law.
If you believe your account or password has been compromised, please contact House of Ellory promptly.
We may suspend or terminate accounts used fraudulently, unlawfully, or in violation of these Terms.
4. PRODUCT INFORMATION
We take considerable care in presenting House of Ellory products accurately.
However, because many of our pieces incorporate natural materials, artisan craftsmanship, hand-applied finishes, textiles, stone, wood, leather, metals, porcelain, and other materials possessing natural variation, individual pieces may vary subtly from photographs, samples, renderings, or other representations.
Variations in grain, veining, texture, tone, pattern, patina, hand-finishing, and other characteristics may be inherent to the material or making process and do not necessarily constitute defects.
Colors may also appear differently depending upon your device, monitor, display settings, lighting conditions, and other factors.
Measurements are provided as accurately as reasonably possible. Certain handcrafted or upholstered products may exhibit minor dimensional variations.
Nothing in this section affects your statutory rights where merchandise is defective, misdescribed, or otherwise fails to conform to applicable legal requirements.
5. CONCEPTUAL IMAGES, RENDERINGS & PRODUCT DEVELOPMENT
This is a section I particularly want House of Ellory to have.
Certain images, illustrations, renderings, room scenes, prototypes, samples, or other visual materials displayed by House of Ellory may represent products during development or may be provided for illustrative or styling purposes.
Where an image is identified as conceptual, illustrative, a rendering, a prototype, or otherwise not a photograph of the final production piece, the final product may differ in details associated with materials, construction, scale, finish, color, hardware, tailoring, craftsmanship, or manufacturing requirements.
Material samples, specifications, approved drawings, order documentation, and final product descriptions may provide additional information concerning made-to-order or bespoke pieces.
We will not knowingly use conceptual representations to materially misrepresent the product being offered for sale.
Nothing in this section limits rights available to consumers where the goods supplied materially fail to conform to the agreed description or specifications.
6. AVAILABILITY
All products are subject to availability.
We may discontinue products, finishes, fabrics, materials, colors, sizes, or other options from time to time.
Certain pieces may be produced in limited quantities or may depend upon the continued availability of particular natural materials, textiles, artisan processes, or manufacturing capabilities.
If we are unable to fulfill an accepted order, we will communicate with you and provide any refund required by applicable law.
7. PRICING
Prices displayed on the Site are shown in the currency indicated at the time of purchase.
Taxes, duties, shipping, freight, white-glove delivery, installation, customs charges, or other applicable charges may be shown separately where applicable.
We make reasonable efforts to ensure pricing is accurate. Nevertheless, typographical, technical, or other pricing errors may occasionally occur.
Where an obvious pricing error occurs, we may correct the error and, to the extent permitted by applicable law, cancel or decline an affected order. If payment has already been collected for an order that is lawfully cancelled, the applicable amount will be refunded.
Nothing in this provision permits us to disregard an otherwise binding consumer contract contrary to applicable law.
8. ORDERS & ACCEPTANCE
Submitting an order does not necessarily mean that House of Ellory has accepted it.
After an order is submitted, you may receive an electronic acknowledgement confirming receipt. Unless expressly stated otherwise, that acknowledgement does not itself constitute acceptance of the order.
An order is accepted when we communicate acceptance or otherwise form a contract with you in accordance with the checkout process and applicable law.
We may decline or cancel an order where permitted by law, including where:
- merchandise is unavailable;
- payment cannot be authorized;
- fraud or unauthorized activity is suspected;
- an obvious pricing or product-information error has occurred;
- shipping restrictions prevent fulfillment;
- an order violates these Terms; or
- we are otherwise legally permitted or required to do so.
Any payment collected for merchandise we cannot lawfully supply will be refunded as required by applicable law.
9. MADE-TO-ORDER & BESPOKE PRODUCTS
Certain House of Ellory products may be made to order, customized, personalized, commissioned, or produced according to customer-selected specifications.
These selections may include dimensions, configuration, upholstery, fabric, leather, wood, finish, color, embroidery, monogramming, hardware, trim, materials, or other specifications.
Production times provided for such pieces are estimates unless expressly agreed otherwise.
Once production has commenced, modifications or cancellations may not be possible.
Return and cancellation eligibility for these products is governed by our Return & Refund Policy and applicable law.
Where a statutory right applies notwithstanding a provision of our policy, that statutory right will prevail.
10. PAYMENT
You agree to provide current, complete, and accurate billing and payment information when making a purchase.
Payment transactions may be processed by Shopify and/or third-party payment providers.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.
We reserve the right to undertake reasonable verification or fraud-prevention measures before accepting or fulfilling an order.
11. SHIPPING, DELIVERY & FULFILLMENT
House of Ellory works with selected ateliers, manufacturers, fulfillment partners, freight carriers, and delivery specialists to fulfill customer orders. Depending upon the nature of the piece and its place of production, merchandise may be dispatched directly from one of our manufacturing or fulfillment partners to the delivery address associated with your order.
The fact that merchandise may be dispatched by a manufacturing or fulfillment partner does not alter your purchase relationship with House of Ellory.
Shipping methods, charges, and delivery services vary according to the merchandise, destination, dimensions, weight, value, and handling requirements of the order. Smaller items may be delivered by parcel carrier, while furniture, oversized merchandise, fragile pieces, and other specialized items may require freight, threshold, room-of-choice, white-glove, or other specialized delivery services.
Where available, applicable shipping and delivery charges will be presented during checkout. Certain oversized, bespoke, international, or specialized deliveries may require a separate delivery quotation or confirmation before fulfillment.
Production time and delivery time are separate. Made-to-order, bespoke, and other specially produced pieces may require a production period before they are ready for dispatch. Estimated production, dispatch, and delivery dates are provided in good faith but are estimates unless expressly stated otherwise or applicable law requires a specific commitment.
Orders containing multiple items may be fulfilled from different locations and may therefore arrive in separate shipments or deliveries.
International orders may be subject to customs procedures, duties, taxes, brokerage charges, or other import requirements. The responsibility for such amounts, where applicable, will be disclosed in accordance with the terms applicable to the order and applicable law.
Risk of loss or damage will pass in accordance with applicable law and the terms governing the particular shipment. Nothing in these Terms transfers risk to a consumer earlier than permitted by mandatory consumer law.
Additional information concerning shipping methods, production and delivery estimates, furniture and oversized delivery, international orders, customs and duties, multiple shipments, and other fulfillment matters is provided in our Shipping & Delivery Policy.
12. RETURNS, CANCELLATIONS & REFUNDS
Returns, exchanges, cancellations, and refunds are governed by the House of Ellory Return & Refund Policy, which forms part of these Terms.
Customers in certain jurisdictions may have statutory cancellation, withdrawal, conformity, warranty, refund, or other consumer rights in addition to our commercial policies.
Nothing in these Terms or our Return & Refund Policy is intended to eliminate rights that cannot lawfully be waived.
13. PERSONAL USE & RESALE
Unless expressly authorized by House of Ellory, products offered through our consumer Site are intended for purchase by end customers rather than unauthorized commercial resellers.
We may impose reasonable quantity limits or decline orders where we reasonably believe purchases are being made for unauthorized resale, fraud, market manipulation, or other improper commercial activity, subject to applicable law.
Interior designers, architects, hospitality professionals, and other legitimate trade customers should contact House of Ellory regarding available trade or professional arrangements.
14. INTELLECTUAL PROPERTY
The House of Ellory Site and its contents—including, without limitation, product designs, product names, collection names, photographs, renderings, illustrations, artwork, graphics, logos, monograms, trademarks, text, copy, layouts, video, audio, interfaces, and other creative materials—are owned by or licensed to House of Ellory and are protected by applicable intellectual-property laws.
The House of Ellory name, logos, monograms, collection identities, and other source-identifying marks may not be used without prior written authorization except as permitted by applicable law.
You may access and use the Site for personal, lawful, non-commercial purposes.
Unless expressly authorized, you may not reproduce, modify, distribute, sell, license, publish, publicly display, commercially exploit, create derivative works from, or otherwise use House of Ellory content in a manner that infringes our rights.
No ownership interest in Site content is transferred to you by your use of the Site.
All rights not expressly granted are reserved.
15. PRODUCT DESIGNS & CREATIVE WORK
House of Ellory invests substantially in original product development and creative direction.
To the extent protected by applicable law, House of Ellory retains all applicable rights in its original furniture designs, textile patterns, embroideries, surface designs, decorative motifs, artwork, tableware designs, architectural elements, photography, renderings, written materials, and other creative works.
Nothing on the Site grants permission to reproduce, manufacture, commission, copy, adapt, commercially exploit, or create unauthorized derivative products based upon House of Ellory designs.
16. USER SUBMISSIONS
If you voluntarily submit reviews, photographs, comments, feedback, suggestions, testimonials, or other content to House of Ellory, you represent that you have the right to provide that material and that doing so does not violate the rights of another person.
You may not submit unlawful, defamatory, infringing, fraudulent, obscene, abusive, malicious, or otherwise unlawful material.
If House of Ellory wishes to use customer photographs, testimonials, or other submitted creative content for advertising or promotional purposes beyond what is reasonably necessary to operate the relevant Site feature, we may seek additional permission where required by applicable law.
Personal information contained in submissions will be handled in accordance with our Privacy Policy.
17. COPYRIGHT & INTELLECTUAL PROPERTY COMPLAINTS
House of Ellory respects the intellectual-property rights of others.
If you believe material available through the Site infringes a copyright, trademark, or other intellectual-property right you own or are authorized to enforce, please contact:

Your notice should identify the protected work, the allegedly infringing material, sufficient information for us to locate it, your contact information, and the basis for your claim.
Additional information may be requested where required to process a formal copyright notice under applicable law.
18. THIRD-PARTY SERVICES & LINKS
The Site may contain links to or integrations with third-party websites, services, payment providers, social platforms, or other resources.
House of Ellory does not control unaffiliated third-party services and is not responsible for their content, availability, privacy practices, security, or terms.
Your use of third-party services may be governed by separate terms and privacy policies.
19. PRIVACY
Your use of the Site is subject to the House of Ellory Privacy Policy, which explains how personal information is collected, used, disclosed, and otherwise processed.
Our ecommerce Services are powered by Shopify, and certain information may also be processed by Shopify as described in our Privacy Policy.
20. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Site and its general informational content are provided on an “as is” and “as available” basis.
We do not guarantee that the Site will always be uninterrupted, error-free, secure, or free from harmful components.
To the fullest extent permitted by applicable law, House of Ellory disclaims warranties relating solely to the operation and availability of the Site that may lawfully be disclaimed.
Nothing in this section disclaims or limits warranties, guarantees, remedies, or other rights relating to products purchased from House of Ellory that cannot lawfully be excluded or limited.
21. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, House of Ellory and its officers, directors, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from your use of or inability to use the Site.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability that cannot legally be excluded for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where applicable, or mandatory consumer rights.
Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
22. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold House of Ellory harmless from claims, liabilities, damages, losses, and reasonable costs arising directly from:
- your unlawful misuse of the Site;
- your material violation of these Terms;
- content you submit in violation of another person's rights; or
- your intentional interference with the security or operation of the Site.
This provision does not require a consumer to indemnify House of Ellory for House of Ellory's own unlawful conduct, negligence, breach, or other liability where such an obligation would be prohibited by law.
23. INTERNATIONAL USERS & CONSUMER RIGHTS
House of Ellory may make the Site available to customers in multiple countries and jurisdictions.
Laws concerning ecommerce, contracts, consumer protection, product warranties, cancellation rights, and other matters vary internationally.
Nothing in these Terms is intended to deprive you of mandatory protections afforded by the laws applicable to you.
In particular, consumers in the European Economic Area, United Kingdom, and other jurisdictions may have mandatory statutory rights that cannot be waived by contractual terms.
Where a provision of these Terms conflicts with a mandatory consumer right applicable to your transaction, the mandatory consumer protection will prevail to the extent of that conflict.
24. GOVERNING LAW
These Terms and disputes arising from them will be governed by the laws of Ontario and Canadian law, without regard to conflict-of-law principles, except to the extent mandatory laws applicable to a consumer require otherwise.
If you are a consumer residing in a jurisdiction that provides mandatory protections concerning governing law or forum, this provision does not deprive you of those protections.
25. DISPUTE RESOLUTION
Before commencing formal proceedings, we encourage you to contact House of Ellory so that we may attempt to resolve the matter directly.

House of Ellory and the customer agree to make reasonable good-faith efforts to resolve disputes informally where appropriate.
Nothing in this provision prevents either party from exercising a right or remedy that cannot lawfully be restricted.
Arbitration
No mandatory arbitration agreement or class-action waiver is established by this version of the Terms.
If House of Ellory elects to adopt mandatory arbitration in the future, the applicable provision should be separately drafted for the company's jurisdiction and reviewed by qualified legal counsel before publication.
26. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes in our Services, business practices, policies, or applicable law.
When changes are made, we will update the Last Updated date above.
Where required by applicable law, we will provide additional notice before material changes become effective.
Changes will not apply retroactively where prohibited by law.
27. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where appropriate, and the remaining provisions will remain in effect.
28. NO WAIVER
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
A waiver will be effective only to the extent permitted by applicable law and, where appropriate, when made in writing.
29. ENTIRE AGREEMENT
These Terms, together with policies and terms expressly incorporated by reference—including our Privacy Policy, Return & Refund Policy, and other applicable purchasing or delivery terms—constitute the agreement between you and House of Ellory concerning your use of the Site and applicable transactions, subject to any separate written agreement governing a bespoke, trade, or other special order.
